Former "Top Chef" contestant Josie Smith-Malave who became the victim of a gay-bashing attack in September, filed a complaint accusing investigators of not pursuing the case energetically enough.
According to celebrity gossip site TMZ.com, openly-gay Smith-Malave, who appeared on Season 2 of Bravo network's reality program "Top Chef,", slammed the Nassau County Police Department for their "poor" handling of her case, and says she's "disheartened" by the inability of cops to charge the suspects, whom she claims to have already ID'd in lineups.
"What police had told everyone was that this would be treated as a hate crime," said Yetta Kurland, Smith-Malave's attorney, who held a news conference in her Manhattan office Friday. The department "has broken its promise to the public and to my clients to treat the vicious attack ... as the violent hate crime it was."
Following the complaint, Nassau police announced on Saturday they arrested two women in connection with the attack saying one had been made recently and another one was imminent.
Sgt. Anthony Repalone, a police spokesman, said, "The commissioner of police has been personally monitoring this case," while the investigation is active and "this was conveyed to the victim's attorney."
Melissa Trimarchi, 21, is charged with a misdemeanor assault charge. She was released without bail pending a Nov. 30 court date. Elizabeth Borroughs, 20, also is charged with misdemeanor aggravated harassment. She also was released and is due in court Friday.
A third person, Matthew Walli, 20, was arrested in September and charged with robbery as a hate crime. He is in jail awaiting trial.
In early September, Smith-Malave and her friend were attacked by a group of teenagers at Partners in Sea Cliff. The suspects hurled anti-homosexual slurs, threw sticks and beat them, Kurland said.
