Three NYPD officers were charged Tuesday in the sodomy case
brought against them by a 24-year-old tattoo artist.
Police Officer Richard Kern, 25, was charged with attacking Michael
Mineo, who works at a tattoo parlor in Brooklyn, on October 15 in a Prospect Park subway station. Kern faces up to 25
years in prison if convicted of aggravated sexual abuse and assault. He was
freed on $15,000 bail.
Two other officers, Alex Cruz and Andrew Morales, both 26, were
charged with hindering prosecution and obstructing justice. They face 4 years
in prison if convicted. They were freed without bond.
The other two officers who completed the group accused of
having attacked and sodomized Mineo testified against the officers before a
grand jury. Andrew Jugraf, 30, was not charged and neither was NYPD transit cop
Kevin Maloney, who was declared a witness back in October, because he arrived
after the alleged assault.
Kern is believed to be the lead assailant in the case. Maloney
reportedly told investigators that he saw Kern sexually assault Mineo with a
police baton.
When Michael Mineo first made his accusations public in late
October, he said he believed he had been sodomized with a police radio antenna.
Authorities said Mineo’s DNA was found on Kern’s baton, reports the New York Daily
News.
Police officers said they saw Mineo smoking marijuana; they
approached him but Mineo tried to escape by running into the subway. The
officers followed him and he resisted arrest. They issued him a summons for
disorderly conduct and released him.
What Mineo adds to this version of what happened on Oct. 15
is that he was assaulted before being released and threatened to keep quiet
about the alleged attack.
Defense lawyers insist the officers are guilty of no
wrongdoing.
Mineo’s lawyer, Kevin Mosley, previously said his client
checked into Brookdale University Hospital
and Medical Center, where he spent four days and
received treatment for severe abdominal pain and rectal injuries. Mineo
returned a week later to hospital with a stomach abscess, related to the
attack, the lawyer said. Medical records show that he was diagnosed with “anal
assault.”
