Tesla Motors filed a lawsuit in
San Mateo Superior Court in California on Monday against one of its competitors
for allegedly stealing design ideas and trade secrets. The company claims that former employee Henrik
Fisker, Fisker Coachbuild CEO, and his Chief Operating Officer Bernhard Koehler
accepted the job with Tesla only to gain access to confidential information to
later use on a competing vehicle.
The lawsuit claims that before
working with Tesla, Fisker had absolutely no experience with hybrid technology,
and Fisker allegedly sabotaged Tesla to use confidential information for its
own car, later unveiled as Karma.
“I think it’s ironic that Fisker
chose to name his car Karma, when what he’s done is very bad karma,” said Adam
C. Belsky, lawyer at Gross, Belsky and Alonso, which represents Tesla, The
New York Times reports.
Tesla initially hired Fisker to
work on the design of a four-seat sedan, named White Star, which was supposed
to become available for sale in 2010. The company complained that due to Fisker’s
release of Karma, they were forced to delay the production of the White Star to
change the design.
“It caused a slight delay in
White Star because we could not use the Fisker styling,” said Elon Musk,
chairman of Tesla, NYT reports. “I’m not really a car designer. We’ll see what
people think of cars designed by me versus Fisker; it’s the amateur versus the
professional.”
The purpose of the lawsuit is to
stop Fisker from using Tesla documents and return the money from the contract.
Tesla is also looking for unspecified punitive damages. Fisket Automotive was
not available for comments on the litigation.
