Sean Preston and Jayden James, Not Safe?

Britney Spears may have been cleared on that pup of hers but now it seems an investigation is possible as to the safety of her two toddler sons.

An unscheduled court hearing took place at L.A. County Superior Court on Monday, according to media reports. Those attending were Britney's lawyer, Dennis Wasser, Kevin Federline’s attorney, Mark Vincent Kaplan, and a lawyer from the Los Angeles County Counsel assigned to the dependency court.

TMZ reports that the L.A. County Department of Children and Family Services is conducting an active investigation into the safety of Britney and Kevin’s two sons, Sean Preston, 23 months, and Jayden James, 11 months.

Oh, how the plot thickens.

Former hubby Federline wants to be a truly good daddy to his two sons and wants to take them away from Britney, for good. (No word however about him taking his other two children from their other mommy, former girlfriend Shar Jackson.)

When Britney and Kevin’s divorce was complete at the end of July, the two ex-spouses shared joint legal and physical custody over their two boys. Within days, K-Fed had filed for sole custody of the children.

Not long after, his legal team started handing out deposition subpoenas to past and current employees of Britney’s – personal assistants, driver & bodyguard, producer etc.

Federline is apparently attempting to prove that his former lovelady is no fit mother and his lawyers will question members of her entourage about her parenting skills and lifestyle, including drinking and partying habits.

Perhaps it was just a matter of time before Kevin’s somewhat veiled hints that Britney was not a fit mother would turn into speculation that the pop singer really cannot take care of her children…

Kevin’s lawyers can cite a wallop of events and circumstances that show Britney as quite chaotic and unpredictable.

Among the latest is an investigation performed by the Society for the Prevention of Cruelty to Animals, into an accident involving Britney’s dog (who now has a fractured leg). TMZ reports the pop icon was cleared of any blame, with the SPCA stating that the accident was just that – an accident.

If the custody case involving Britney and Kevin goes down the road of “who is the safer parent,” both parents could lose custody of the boys, if they are deemed unfit by the judge.

Los Angeles criminal defense attorney Steve Cron told “Access Hollywood” that in this case, the county would file a petition in juvenile court. If neither Britney nor Kevin can convince the court that they are fit as a parent, Cron says, the county could take custody over the kids.
