Pregnant Man Who Gave Birth Stirs Legal Questions

Thomas Beatie’s case sent shock waves around the world and stirred global interest. Only hearing the word “pregnant man” is enough for anybody to all eyes and years. However, the case of the woman who became man and then mother to his child and also father after birth (‘cause he’s a man, right?) raised some legal problems as well.

The transgender recently announced that he is pregnant with the second child. The news was given during an exclusive interview with Barbara Walters. Well, it may be curiosity first and then smiles and ohhhs after seeing the baby, but the Beaties are facing legal problems: having their roles as parents legally recognized. The couple found themselves in a legal thicket that serves as a cautionary tale for other transgender families.

The problem is that Thomas Beatie, who is legally male, was listed by the state of Oregon on the birth certificate as the "mother" and his wife Nancy was listed as the "father" of their daughter Susan. Beatie gave birth to Susan in June.

The state then changed the designations with the gender-neutral term "parent" in order to avoid confusion in the cases of birth certificates of the children from same sex couples. A good and effective measure, I’d say. But the Beaties aren’t happy at all with the change.

"In essence, they are invalidating our marriage," Thomas Beatie said. "It is very upsetting to me. I feel that it's a flawed document."

"I am my daughter's father, and that's all I'll ever be to her. Nancy is Susan's mother,” said Thomas Beatie to make it clear.

The interesting interview with Barbara Walters is called "What Is a Man, What Is a Woman? Journey of a Pregnant Man." It airs tonight on "20/20" at 10 p.m. ET on ABC.
