Actress Mischa Barton, 21, was charged on Tuesday with drunken driving, marijuana possession and driving without license, according to Los Angeles prosecutors.

According to the court papers, she faces charges for driving under the influence of alcohol or drugs, driving with a blood alcohol level of 0.08 percent or higher, driving without a valid license and possession of 28.5 grams or less of marijuana.

In a statement released by her publicist, Barton’s attorney, Anthony Salerno, said:

"We are pleased that the District Attorney’s Office has very carefully reviewed all the evidence in Ms. Barton’s matter and has chosen to file only misdemeanor charges against her," E! News reports.

Salerno also said that the D.A.’s office treated this case just like any other and that Barton didn’t receive any special treatment and that they did their job.

He added:  "As previously stated, Ms. Barton has taken full responsibility for any mistakes in judgment that she may have made.  We will, of course, conduct a full review of all evidence received from the D.A.’s Office before making any final decisions on the resolution of the legal issues, but we are confident that this matter will be handled by both sides in a professional and respectful manner."

Mischa Barton was arrested on December 27 in West Hollywood for driving under the influence.

Around 2:46 a.m. Barton was pulled over at the corner of La Cienega and Santa Monica boulevards after she was seen driving her Range Rover on two lanes and failing to signal when she made a turn.

At 3:10 a.m. Barton was arrested and after 10 a.m. was released for a $10,000 bail.

The former “O.C.” star was also detained for possession of an illegal narcotic and driving with an invalid license.

Barton is known for her role of bad girl Marissa Cooper on the “O.C.” series. Since she left the TV drama she has been focusing on movies. She already has three roles in upcoming films: “Virgin Territory”, “St. Trinian’s” and “Closing the Ring.”

On Thursday Barton is scheduled to make an appearance in court
