The Hollywood socialite’s lawyer is trying to buy more time yet again for Nicole Richie’s trial on a charge of driving under the influence of drugs and alcohol.
After last month Los Angeles Superior Court Commissioner Steven Lubell set a new trial date for July 11th, he is scheduled to make a decision on Wednesday whether to postpone Richie’s trial again until next month, or not.
On Tuesday, Shawn Chapman Holley, Richie’s lawyer, appeared in front of the judge to ask that the trial date be pushed back to August 5 because an expert witness central to Richie’s defense was not available to testify on Wednesday, July 11th, as scheduled.
"His testimony will be critical to Miss Richie's case and there is no other expert retained by the defense who can testify in this regard," Holley wrote in the court documents.
Last time the judge approved the delay was due to Holley’s vacation which could have collided with the trial.
However, despite the judge’s decision, the case will be delayed at least with one day and the 25-year-old "Simple Life" star won’t be required to attend the hearing because she is facing a misdemeanor charge, Jane Robison, a spokeswoman for the Los Angeles County District Attorney's Office said.
In addition to the single count, the case contains an allegation that Richie had a prior misdemeanor DUI conviction in June 2003. If convicted, the skinny starlet faces a minimum punishment of 90 days behind bars under Californian legal rules.
