Mischa Barton To Avoid Jail In DUI Case

Actress Mischa Barton is reportedly going to plead no contest to DUI, which is similar to a guilty plea, part of a deal that will spare her any jail time, People.com reported.

During her upcoming arraignment in a Beverly Hills court on Thursday, the former "O.C." star will also agree to serve a three-year unsupervised probation term. However, the starlet is expected to receive a sentence that includes a three-month alcohol-education class, and pay a fine of approximately $1,700.

One charge of marijuana possession against the actress will be dropped, due to the small amount found while another charge of driving without a license will be reduced to an infraction, according to a source.  

The deal, which is common for first-time offenders, was negotiated by Barton's lawyer Anthony V. Salerno and is expected to be signed off on by the court.

The 21-year-old actress was charged with driving under the influence of alcohol or drugs, driving with a blood alcohol level of 0.08 percent or higher, driving without a valid license and possession of 28.5 grams or less of marijuana, stemming from her December arrest for driving under influence.

She was pulled over by police officers after she was seen driving her Range Rover on two lanes and failing to signal when she made a turn. She was taken to the West Hollywood Sheriff's station, booked and released on a $10,000 bail.

A statement released by the District Attorney's office at the time of her charging, said that Barton was taking full responsibility for any mistakes in judgment that she may have made.

Barton is known for her role as Marissa Cooper in "The O.C." series. Since she left the TV drama she has been focusing on movies. She already has three roles in upcoming films: "Virgin Territory", "St. Trinian’s" and "Closing the Ring."
