A police officer shot a man 20 years ago, leaving him
paralyzed. After several trials, the man must pay $100 for court costs.
According to The Associated Press, Darryl Barnes was supposed
to get $76, 4 million from his first trial. Did I mention that this was the
third battle with the court? I guess the
third time wasn’t at all lucky.
His first trial was in April 1998 when the jury awarded
Barnes $76.4 million. The trial judge reduced it to $8.9 million.
The second trial was in March 2003 and the jury awarded him $51
million. The judge reduced it to $10.75 million.
The third trial and, apparently, the last ended with the
judge deciding that Barnes should not be awarded at all. Moreover, he has to
pay $100 which represents the court costs.
"Motion for leave to appeal denied with one hundred
dollars costs and necessary reproduction disbursements,” said the ruling,
according to The Associated Press.
There are two side of this story. One from the prosecutors
who said that, on Aug. 22, 1988, Officer Franz Jerome saw Barnes running with a
Tec-9 semiautomatic pistol and told him to stop. After identifying himself, the
police officer saw that Barnes shot at him. Jerome fired back, hitting Barnes. The
injuries left him paralyzed.
The other side of the story comes from Barnes attorneys who
said that he was shot in the back after he put the gun down. Apparently he
picked up the weapon from a fight with 2 men.
Barnes didn’t testify at his second trial, saying that he
was too mentally and physically ill.
He didn’t show up at his third trial, either, invoking the
same reasons.
The judges said that they dismissed the case because Barnes
didn’t show up at all at the trial and didn’t prove that he was physically or
mentally unfit to participate.
His lawyers were thinking if they could take the case to
federal court.
