The Beverly Hills Courthouse proved to be lenient towards troubled youngster Lindsay Lohan today, sentencing her to 1 day in jail, three years of probation and 10 days of community service.
It would seem prosecutors took some kind of pity on Lindsay Lohan this week. The L.A. County District Attorney filed seven misdemeanor charges against the actress: two counts each for driving under the influence, driving with a blood alcohol count of more than .08 percent, being under the influence of cocaine and one count of reckless driving.
Had Lindsay been charged with felonies, she could well have spent some 365 days in jail. Or considerably more.
TMZ reports that the D.A. took several aspects into consideration upon deciding on her criminal charges. For one thing, Lindsay’s cocaine traces “were below the .05 grams required by office policy for felony filing,” therefore not qualifying for a felony charge.
Also, the D.A. looked at Lindsay’s history. Being arrested twice during a relatively short period of time indicated to law enforcers that she was struggling with an addiction. Being only 21 and having been raised in quite an unstable environment, as well as her recent visits to rehabilitation facilities determined prosecutors to not file felony charges.
TMZ quotes a law enforcement source explaining: “Prosecutors in this county see a lot of kids in crisis. There are lots of kids struggling with addiction. The first sign of trouble usually involves a car. We're not going to throw every one of them in prison. It doesn't make sense.”
Considering the actress to have enough troubles already to deal with, the prosecutors decided to take it easier on her.
As a result, Lindsay has been sentenced to one day in jail and ten days of community service. She has been placed on three years’ probation and ordered to attend a drug-treatment program, according to the Associated Press.
The actress, who pleaded guilty to the charges, will also pay a fine and complete a three-day county coroner program that will require her to visit a morgue and talk to victims of drunken drivers, reports the AP.
Lindsay issued a statement to MTV News, in which she says: “It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs. Recently, I relapsed and did things for which I am ashamed. I broke the law, and today I took responsibility by pleading guilty to charges in my case.”
Lindsay was arrested twice this summer: first in late May, when she crashed her car into a tree and again in late July, when she allegedly chased another car. Both times she had been drinking and traces of cocaine were found in her possession.
The young actress is currently at the Cirque Lodge treatment center in Sundance, Utah. This is the third time she has checked into rehab this year.
“No matter what I said when I was under the influence on the day I was arrested, I am not blaming anyone else for my conduct other than myself,” she says in her statement. “I thank God I did not injure others. I easily could have. I very much want to be healthy and gain control of my life and career and have asked for medical help in doing so.”
