Lindsay Lohan and a busboy, who filed a lawsuit against her
last year over a car accident, have finally reached a settlement
The suit was filed by Raymundo Ortega in June last year, after
Lohan smashed her Mercedes-Benz in his van as he was making a turn in October
2005.
"It's been resolved," said Robert G. Klein, the
attorney for Ortega, who settled for an undisclosed amount on Wednesday.
Even though according to the police, it was his fault for
having his van wrecked, Ortega sued the actress, who was 19 at the time of the
crash, for $200,000 in damages claiming she was drunk.
According to legal papers, Lohan had "consumed alcohol
and became intoxicated" prior to the accident, but a police report stated
that there were "no signs" of this and ruled that the crash had been
caused by Ortega making an illegal U-turn.
Within the police report, the responding officer wrote
“while speaking with the involved parties, I did not observe any objective
signs of either alcohol or drug intoxication and determined that no further
investigation regarding intoxication was warranted.”
At that time, Lohan, who has been in rehab three times last
year, denied claims she had been under the influence of alcohol and dismissed
the lawsuit as "nothing more than an attempt to extort money from a
celebrity by making false and scurrilous allegations in a complaint."
However, she later filed a countersuit seeking $75,000 from
Ortega, claiming he (and several unnamed defendants) were the ones who caused
the accident. She alleged that Ortega was "negligent in the ownership,
operation, repairs and maintenance" of his vehicle.
