A Lexington, Kentucky eight-grader is facing felony charges after he put some crumbled peanut butter cookies in the lunchbox of a fellow classmate known for having severe allergic reaction to peanuts or peanut products.

The allergic student did not eat the cookies Thursday at Morton Middle School in Lexington and did not have a reaction.

According to Fayette County schools’ representative Lisa Deffendall, the accused student was seen putting crumbled peanut butter cookies in the allergic student’s lunchbox during a lunch break. After an investigation, he was arrested on a felony wanton endangerment charge, the Associated Press reports.

State legal statutes say a person is charged with felony or first-degree, wanton endangerment when someone is suspected of engaging in conduct that causes the danger of death or physical injury to another person.

The student who was charged will be placed into the juvenile criminal justice system.

Deffendall said it was well known that the other student was allergic to peanuts. She also added there was no known history of problems between the two 13-year-olds.

It is already a fact that, for people allergic to peanuts, even trace amounts of peanut oil can cause severe reactions and even death. Symptoms of allergies can include hives, welts and swelling that can restrict airways.
