Legal Tug of War Over Britney

Just as dad Jamie Spears got rid of Sam Lutfi and that manager that apparently broke court orders, another person has entered the picture – a lawyer claiming to have been hired by Britney and who says her civil rights are being violated.

Attorney John Eardley claims to have been hired by pop singer Britney Spears on Feb. 12 and seems determined to defend the 26-year-old’s civil rights, which he alleges are currently being violated by her father Jamie Spears though the co-conservatorship that allows him to control her finances and to make decisions regarding her personal life.

Eardley filed documents in federal court late last week claiming Jamie Spears is holding his daughter in an unfair situation.

Papa Spears’ lawyer filed another set of documents in response Monday, asserting that Britney’s current medical condition has been ascertained in state court: she “lacks the capacity to hire an attorney,” therefore Eardley cannot represent her, the Associated Press reports.

“Mr. Eardley cannot remove the conservatorship proceedings on his own behalf,” the papers state.

Spears senior has been Britney’s co-conservator, along with lawyer Andrew Wallet, ever since the 26-year-old mother of two was hospitalized for a second time this year, on Jan. 31. At the time, Britney was taken to the UCLA Medical Center’s psych ward by ambulance and placed on a 72-hour hold for psychiatric evaluation.

Her stay was extended and she was eventually released earlier than expected, because it was decided that she no longer posed a threat to herself or to others. While in the facility, it was determined that Britney is incapable of taking care of herself or her affairs.

Eardley stated in his motion that Britney has “been in a form of private confinement for nearly a month,” the AP reports, and asked that “the conservatee be brought into court for a hearing, where the court can evaluate her in person and hear testimony directly from her.”

While the grown-ups in the case argue among themselves, Britney has at least had the comfort of seeing her two small boys again, Sean Preston, 2, and Jayden James, 1. The little guys were brought over to her house this weekend, where they spent about 3 hours, People magazine reported. Grandpa Spears and Brit’s psychiatrist were also present during the visit.

Britney saw her sons a second time on Monday, when they were driven to her house by Kevin Federline's bodyguard for another three-hour visit, People reports.

Britney has been “helped” before by self-proclaimed manager Sam Lutfi, whom Lynne Spears described in court documents as a manipulative person who drugged her daughter, isolated her from the world and allowed paparazzi in her house.

Lutfi was finally served a temporary restraining order earlier this month; it will be in effect until March 17 and prevents Lutfi from approaching either Britney or her family.

Another eager “helper,” now-former manager Howard Grossman, was fired by Britney’s dad in mid-February, after a court agreed that Grossman failed to follow directions established by Britney’s co-conservators and to turn over requested documents.

Grossman is accused of having arranged meetings for the pop star upon her release from the UCLA Medical Center, against her parents’ wishes. He also allegedly provided Britney with a car, although it is the co-conservators who control her assets.

While they do say that appearances can be deceiving, ever since Jamie Spears took charge over Britney’s affairs, her public outings have shown her more composed, calm and tastefully dressed than she has in months. Britney seems to be changing for the better, with her parents’ support.
