A lawsuit filed by motorcycle daredevil Evel Knievel against rapper Kanye West over the use of Knievel’s trademarked image in the 2006 West video for the song “Touch the Sky” has been settled “amicably,” it was announced Tuesday.
Iconic motorcycle daredevil Evel Knievel took offense with Kanye West’s video for “Touch the Sky,” a single off his second album, “Late Registration,” and filed a lawsuit against the rapper, his record company, Roc-A-Fella, video director Chris Milk and distributor AOL in December 2006, for trademark infringement.
The 69-year-old claimed his reputation was damaged because of the “vulgar and offensive” images appearing in the video and even accused the rapper of using the Knievel image to “promote his filth to the world.”
In the video, Kanye is depicted as a jumpsuit-wearing, motorcycle-jumping “Evel Kanyevel” who attempts to soar across Idaho's Snake Canyon. Knievel made the same attempt in 1974 and failed.
While the motorcycle daredevil argued that the footage tarnished his reputation and that West’s portrayal was “directly counter to Evel Knievel's long-established public persona, utterly inconsistent with his toy products and appeal to children,” West's attorneys argued the video amounted to satire, and was protected by the First Amendment.
It was announced Tuesday that the bitter lawsuit, which saw Knievel seek an injunction to bar the video from further distribution and request unspecified monetary damages, had been resolved amicably.
The two men reportedly met recently at Knievel’s Clearwater condo and the stuntman was surprised to discover in Kanye a pleasant person, reports the Associated Press.
“I thought he was a wonderful guy and quite a gentleman,” Knievel said. He added, “I know he's had some tough times the past few weeks, and I hope things work out,” referring to the sudden death of Kanye’s mother, Donda West, earlier this month.
“We settled the lawsuit amicably,” Knievel said. “I was very satisfied and so was he.”
Roc-A-Fella Records confirmed the settlement on Tuesday in a press release. The two parts have agreed not to publicly discuss the terms of the settlement.
