The twelve jurors who have it upon themselves to reach a
verdict in Britney Spears’ traffic trial were no more successful Monday than
they were Friday, when they began deliberations, and are to resume their discussions
Tuesday morning.
The jury was split 10-2 Monday on whether Britney Spears was
guilty or not of driving without a license. A foreman told Los Angeles County Superior
Court Judge James A. Steele they had voted three times since starting
deliberations Friday, each time voting 10 to 2. He did not indicate which way
they had voted.
After lunch, the judge asked them to deliberate for another
20 minutes and take a fourth vote. The jurors had complained that they were
becoming more and more “entrenched” in their positions with each return to the
assembly room.
They did not return from their fourth vote but requested a
reading of Jamie Spears’ testimony. Britney Spears’ father is the defense’s
sole witness. He testified Thursday that his 26-year-old daughter does not
consider California her permanent residence and
that Louisiana
is her real home.
In August 2007, the singer was driving her car in Studio City
when she hit a parked car and left the scene. She was reportedly fleeing
paparazzi at the time. It was found that she did not have a valid California driver’s
license.
Her defense lawyer maintains that Spears did not break the
law since she did have a valid Louisiana
driver’s license. The prosecution contends she should have had a California license
because she resided in the state.
Prosecutor Michael Amerian told the jury during closing
arguments Friday that major events of Spears’ life have taken place in California: her
marriage, the birth of her two sons, the divorce.
He added that a few months prior to the fender bender, the
singer had applied for a California
license, which she did not receive, and this showed her intent to stay in the
state.
Spears faces a maximum of six months in jail and a $1,000
fine if convicted on the misdemeanor charge. She originally faced another count
of hit and run but this charge was dropped after she reached a civil settlement
with the owner of the other car.
Spears has not appeared in court during the trial.
Her father testified last week that she currently lives in California because of
her two young children, of whom former husband Kevin Federline has primary
custody. Spears said his daughter has visitation rights which she needs to
“augment” by living in the same state as her children. He also said there are
plans to move to Louisiana.
Spears’ attorney, J. Michael Flanagan, has argued that his
client has only come to be on trial for the August 2007 incident because of her
celebrity.
