A woman from Cincinnati,
Ohio was awarded $22.6 million in
damages on Monday in a medical malpractice lawsuit.
Back in 1997, Heather Grow was pregnant with her first child
when she was diagnosed with a narrow pelvic arch. Despite this diagnose and the
fact that the baby was going to be big (nine pounds), the woman was allowed to
give birth the natural way. Therefore, Cassie, the girl who now is 11-year-old,
spent 13 hours in the birth canal before she was delivered by cesarean section.
“The child got stuck. It was clear that she was pushed
through an (opening) she couldn’t fit. And this went on for hours and hours. It
was like trying to fit a watermelon through (an opening) the size of an apple,”
the mother’s attorney, Patrick P.J. Beirne, of Covington said, as quoted by the local
newspaper Cincinnati Enquirer.
Moreover, Lisa Yang, the doctor who assisted Grow at birth continued
to administer her drugs to make the uterus contract hoping the baby would come
out. The result was the opposite, as the uterus kept on contracting on the baby’s
stuck head, causing brain damage.
Cassie suffered brain damage that will haunt her all her
life. She is a spastic quadriplegic, meaning she can’t use her limbs properly,
she can walk short distances but with the help of a walker, her vision is
impaired, she has problem using her hands and is mildly retarded, another Grow
attorney, Mark Mueller from Austin Texas said.
Given the circumstances, a Hamilton County
jury on Monday found Dr. Young and her doctors group, Group Health Associates
negligent. Therefore, they were ordered to pay the Grow family $22,646,023,
money that will be used to pay for the care needed by Cassie.
However, no money in the world could make Cassie healthy
again and her parents smile again. Her mother said she would rather have a
healthy daughter than millions awarded by the jury.
