Jurors In MySpace Case Have Reached Three Verdicts Out Of Four

Jurors in the MySpace case sent a note to the judge late Tuesday, suggesting that they have reached verdicts on three of four counts against a Missouri mother accused of conspiring to harass a 13-year-old girl with Internet messages that caused her to commit suicide.

The note, sent on the first day of deliberations, asked “Can we be hung on one count but unanimous on the others?” The judge, U.S. District Court Judge George Wu, told the jury to return on Wednesday and resume deliberations, stating that if the jury is still at an impasse, they must hand him a note. Judge Wu did not ask the jurors which count was at issue, nor did he ask what the vote count was.

During Monday’s closing arguments, prosecutors had stressed the emotional component – the suicide of Megan Meier, who was fooled by Lori Drew, the mother of Megan’s best friend, Sarah. Drew has pleaded not guilty to one count of conspiracy and three counts of accessing computers without authorization, but she could face as many as 20 years in prison if convicted of all counts.

U.S. Attorney Thomas O’Brien, summarized the facts, starting with the one that Drew decided to humiliate Megan by inventing a make-believe boy named “Josh Evans”, who would woo her on the MySpace Web site, then be revealed as nonexistent. In her defense, Drew says this is a matter of computer law, accusing prosecutors of misleading jurors into thinking it was a murder case.

It seems that the only question remaining is whether Drew violated the terms-of-service agreement of MySpace. Drew’s attorney, Dean Steward, said that Drew, her daughter and assistant Ashley Grills never read the seven-page agreement. He says nobody reads these things, so, therefore, how can they be violated?

However, Drew’s little game caused Megan to commit suicide on October the 16th, 2006, after receiving a message from Josh, telling her the world would be better off without her. This case is prosecuted in Los Angeles because MySpace computer servers are based in the area.
