Judge Wants to Hear Proof of Foxy's Impending Deafness

A disbelieving judge wants proof before granting jailed rapper Foxy Brown permission to fly out to Los Angeles in order to have a medical intervention that prevents alleged impending deafness.

Foxy Brown, real name Inga Marchand, wrote to the judge handling her case to be allowed to make a medically necessary trip to California, the only place where her hearing condition can be remedied.

Foxy was sentenced to one year behind bars in September 2007 for violating probation. She has eight more months to serve but in a letter she wrote to Supreme Court Justice Melissa Jackson on Tuesday she claims that her hearing condition is worsening in jail and that her cochlear implant needs urgent repair.

“I am terrified of not hearing a fire alarm go off, or being locked in a cell, and someone not being kind enough to let me out, since not everyone understands the severity of my condition,” the singer wrote in her petition.

The 29-year-old first revealed her hearing problems during a court appearance in late 2004. It was that year that the Manhattan judge put her on probation after she pleaded guilty to misdemeanor assault of two employees in a Manhattan cosmetic salon in August 2004.

Foxy insists that her hearing aid needs fixing and that the only place where this can happen is Los Angeles' House Clinic.

She appeared in court Thursday, when her lawyer, Laura Dilimetin, pleaded with Judge Jackson to amend her client's sentence so she could travel to the West Coast and have the necessary medical intervention.

Assistant District Attorney Cindy Chung argued that Foxy had brought no evidence that the medical procedure could only be performed in Los Angeles and added that “the mere existence of a debilitating health condition does not merit a sentence reduction, even if it is a terminal illness.”

“Basically, your honor, this is a desperate and frivolous petition,” Chung was quoted by the Associated Press as saying.

The judge ordered the rapper’s lawyer to hand Foxy’s medical records to the district attorney, the Department of Correction and the Department of Probation.

Foxy previously stated she was pregnant but her manager dispelled such reports once she was sentenced to jail.
