Judge Wants Proof Why Britney’s Case Be Moved To Federal Court

A judge put an end to all the fuss surrounding a mystery lawyer’s attempt to have Britney Spears’ conservatoriship case moved to federal court, by setting a deadline of February 28 for the lawyer to explain why the federal court should get involved in the case.

Judge Philip Gutierrez ordered Jon Eardley, who claims to be representing the troubled pop star, to clarify his reasons why Britney’s conservatorship case belongs in federal court. He also indicated that not all necessary supporting documents were submitted.

The ruling came after attorneys for Jamie Spears, Britney’s father, who currently holds conservatorship over his daughter’s affairs, filed another motion asking that the case remained in state court.

In the legal document, Jamie’s legal team argued that Britney didn’t have the capacity to retain counsel, and that conservatorship matters do not fall under federal jurisdiction. If the case were moved, Jamie Spears could lose temporary conservatorship, which now extends until March 10.

Last week, Eardley filed a motion on Britney’s behalf seeking to have her case takent to the federal level, claiming that her civil rights were being violated by the current ruling, which allows Britney’s father to be her estate’s conservator. While it is unclear who exactly hired Eardley, a court order was given earlier this month preventing the singer from hiring her own attorney.
