Emily Diane Leatherman, the 33-year-old woman who was arrested over the weekend in front of actor John Cusack’s Malibu house was charged Wednesday with a felony count of stalking.

John Cusack had obtained a three-year restraining order against Emily Leatherman in 2006, which prevented the woman from coming within 500 feet of him. She nevertheless showed up Sunday outside Cusack’s Malibu home, in a cab. She was ultimately arrested on suspicion of stalking.

She was charged with misdemeanor counts of disobeying a court restraining order and petty theft Wednesday, reports the Associated Press.

She has been accused of stalking Cusack, and if convicted on this charge, she faces up to three years in state prison, the district attorneys office said, adds the AP. She faces up to a year in jail if convicted of the misdemeanor counts.

The woman pleaded not guilty on all counts and awaits trial on lock-down with bail set at $500,000.

Leatherman has said that her run-ins with Cusack were accidental and that she is one hundred percent not guilty. Officials do not know if she has hired a lawyer yet.

In court papers seeking the restraining order, Cusack said Leatherman was “showing unusual interest by stalking, throwing long letters of interest over my fence in bags with rocks and screwdrivers inside,” according to media reports.

Leatherman was noticed Sunday when a cab driver reported that he had a passenger refusing to pay the due fare for the ride to the area and deputies were called. As they approached the scene, Cusack came over to them and said he recognized the woman and that she had been stalking him.

She was booked at the Malibu-Lost Hills station, on suspicion of felony stalking, violating a restraining order and petty theft.

Cusack told police officers that he was not aware of Leatherman having been on his property that day.

Leatherman has a series of prior offences, among which being arrested last year in front of a Beverly Hills house belonging to Tom Cruise, another one of her interests.
