Back in August, police raiding the apartment of former Intel
engineer Biswamohan Pani on a tip from the company, found sensitive and
confidential data on his computer that had to do with the next generation of
Intel Itanium processors. That data shouldn’t have been there. Now following an
investigation the district court of Boston has charged Mr. Pani with four
counts of wire fraud.
Pani had resigned from Intel in May, agreeing to continue
working there through June 11, saying that he would use his remaining vacation
time to close out his time with the company. However he had been engaged by
rival company Advanced Micro Devices (AMD) as soon as June 2, when he still had
access to his Intel laptop and to the Intel computer network. The FBI alleges
and Pani was indicted for collecting the sensitive information he had access to
as an Intel employee for its competitive value as its new employer.
It should be noted that this new employer needn’t
necessarily have been AMD, as apparently the company was unaware of Pani’s…
enterprise, and he had intended to use the stolen information as his own in
order to advance himself in his new job, says the FBI.
The FBI and the Justice Department intervened and
investigated Pani after being alerted by Intel, which learned of the affair
from another Intel employee.
The four charges of wire fraud were brought against Mr. Pani
on Wednesday to the Boston District Court in addition to a theft of trade
secrets charge. If found guilty Biswamohan Pani could face up to 10 years in
prison for the theft of trade secrets charge, and up to 20 years for each count
of wire fraud.
