Actress Heather Locklear has been finally charged with one count of driving under the influence of drugs in connection with her September arrest in Montecito, Calif., People reported.
The misdemeanor charge, filed Monday by the Santa Barbara District Attorney's Office, specifies that the drugs in question were "prescription medications." If convicted, the actress, 47, faces penalties ranging from a fine to up to six months in county jail.
"Lab tests showed she had no alcohol in her system and no illegal narcotics of any kind," said Senior Deputy District Attorney Lee Carter. "We believe that the prescriptions she was taking could have impaired her ability to drive a motor vehicle safely." However, specific details on which medications she took could not be revealed, due to privacy laws.
Although she was initially booked on charges of driving under the influence of drugs and being under the influence of a controlled substance, the second charge was not filed because, "There were no illegal substances in her system," Carter said.
On September 27, the actress was taken into custody after a woman, who previously worked as a celebrity news reporter, called 911 to report that Locklear appeared to be driving drunk, and then took photographs of the actress' DUI arrest. Luckily, no one got hurt in the incident.
Locklear is scheduled for arraignment on Jan. 26. Her attorney, Blair Berk, had no comment when reached via e-mail Monday.
Prior to her arrest, the actress, who divorced Bon Jovi guitarist Richie Sambora last year, spent a month in a treatment center for anxiety and depression. Earlier this year, Locklear's doctor called 911 after talking with the former "Melrose Place" actress. The conversation left him worried that she might overdose on antidepressants. Paramedics arrived at her home, but after ten minutes they decided she was okay and did not take her to the hospital.
Locklear, whose recent work includes guest appearances on " Hannah Montana" and "Rules of Engagement," can next be seen in a Lifetime movie called "Flirting with 40."
