Dennis Quaid and his wife Kimberly reached a settlement with
Cedars-Sinai Medical Center
for $750,000 over a medication error last year that nearly killed the couple's
twin infants, according to papers filed Monday in Los Angeles County Superior
Court.
Nurses at the hospital mistakenly gave twins Thomas Boone
and Zoe Grace 1,000 times the recommended dose of the blood thinner heparin,
leaving them vulnerable to uncontrolled bleeding and leaving them, for a time,
in critical condition.
Cedars-Sinai has been fined $25,000 by the California
Department of Public Health. A hospital spokesman said the facility cooperated
with state authorities and intended to pay the fine. The hospital has since
apologized to the patients' families and said it has taken steps to better
train the staff.
The Quaids also filed suit with the Illinois manufacturer of heparin, Baxter
Healthcare Corporation, accusing it of negligence in packaging adult and
pediatric doses in similar vials. According to the papers, the Illinois action was dismissed on grounds that the event
happened in California,
but it is anticipated that the twins (referred to as "Minor
Claimants") may re-file the action in California Superior Court.
Once a judge signs off on the Quaids' deal with Cedars, the
couple will no longer be able to pursue litigation against the hospital as part
of a good-faith stipulation in the settlement, although they could sue on their
children's behalf for future consequences of the accident.
