A judge ruled on Tuesday that Anna Nicole Smith's 18-month-old daughter Dannielynn is the late Playboy model's sole heir and will inherit her entire estate.
Superior Court Judge Mitchell Beckloff granted a petition filed by Anna Nicole's lawyer and partner Howard K. Stern on October 18, 2007, in which he sought to clarify Smith's intentions regarding her daughter. The star's wish for her fortune was up in the air as her will was written in 2001, before she gave birth to Dannielynn.
According to her will, all of Smith's belongings were to be inherited by her son Daniel, or they should be shared equally if she had future children.
"Although she did not expect to have any children in the future, if she did, she wanted them to share equally in the trust created for [her son] Daniel," her will stated.
Daniel passed away at the age of 20 in September 2006 in the Bahamas, three days after his baby sister was born.
"We and Mr. Stern always believed that Anna Nicole never intended to disinherit her daughter,"' Stern's lawyer, Bruce S. Ross, said after Tuesday's hearing. "I'm pleased to say this chapter in the saga is closed."
Dannielynn Birkhead, who now lives with her father, photographer Larry Birkhead, was officially named Smith's lone heiress while Stern and Birkhead were named trustees of the trust set up in Dannielynn's name.
Under the ruling, the toddler could stand to inherit millions of dollars from the estate of Smith’s second husband, billionaire J. Howard Marshall, whose estate is still in litigation in 9th U.S. Circuit Court of Appeals.
At the time of her death in February 2007, Smith was embroiled in a legal battle over the will of the billionaire oil tycoon whom she married when she was 26 years old and he was 89. His death 14 months later triggered a heated battle between Smith and Marshall's children.
