The Center for Science in Public Interest (CSPI) have filed a class action lawsuit against Coca-Cola. The suit states that Vitaminwater, the Coke-owned brand, is guilty of deceptive and unsubstantiated claims. Glacéau Vitaminwater has long been marketed as a healthy alternative to other beverages, and that's thanks to its added vitamins and minerals.
However, CSPI does not believe that “rubbish” and has decided to take legal action against many claims like 'rescue', 'energy' and 'endurance'. As a lead argument, CSPI says that a flavored sugar water shouldn't be marketed as a health drink. The brand's marketing claims the products can reduce the risk of chronic disease and promote healthy joints.
The health advocacy group thinks the drink is more likely to do harm than good, considering the 33 grams of sugar and they consider the marketing of Vitaminwater is an irresponsible act by Coca-Cola. Another curious thing made by the beverage company is the double labeling, as the servings of calories and other bad stuff are shown per every eight ounces while the vitamins and minerals are labeled per bottle.
As for Coke's side, they say this is a ridiculous and ludicrous lawsuit, as Vitaminwater is a great tasting, hydrating drink, with essential vitamins and water. Coke purchased Vitaminwater for $4.1 billion in 2007, and the company also says CSPI just wants to bring attention to themselves, one week before the inauguration of the US president.
This is not Coca-Cola's first fight with CSPI, as in 2007 the group sued the company over claims that its Enviga brand burns more calories than it consumes, resulting in weight loss. This suit is still pending. Furthermore, Coke also received a letter from the Food and Drug Administration (FDA), stating that Diet Coke Plus' nutrient claims are in violation of the Federal Food, Drug and Cosmetic Act.
