Francis Morrissey, former lawyer of the late Brooke Astor, is charged with forgery and conspiracy along with the philanthropist’s son, Anthony Marshall, and expected to turn himself in Friday.
Anthony Marshall, the 83-year-old son of the late Brooke Astor, who died in August at the age of 105, was indicted by a grand Monday on 16 counts, including grand larceny, criminal possession of stolen property, conspiracy and falsifying business reports. He surrendered to authorities Tuesday morning.
Astor’s former lawyer, Francis Morrissey, was indicted on six counts, including forgery, conspiracy and possession of a forged instrument.
The two men are accused of having conspired to persuade Astor, who was in failing health and had been diagnosed with Alzheimer’s, to change her will and leave money to her son, when in reality she had long wished to leave it to charity.
District attorney Robert M. Morgenthau said Monday: “Marshall and Morrissey took advantage of Mrs. Astor’s diminished mental capacity in a scheme to defraud her and others out of millions of dollars.
“Marshall abused his power of attorney and convinced Mrs. Astor to sell property by falsely telling her that she was running out of money. He is charged with stealing money from her as well as stealing valuable art work from her Park Avenue apartment.”
While Marshall surrendered to authorities Tuesday, Morrissey was expected to do the same by the end of the week. According to the New York Daily News, Morrissey, 64, was out of the country when Marshall was indicted Tuesday. The 83-year-old pleaded not guilty to the charges.
The paper also reports that Morrissey has been accused before of “preying” on elderly women.
In 2000, he was named to inherit a considerable portion of a $15 million estate from 91-year-old Elisabeth Von Knapitsch, reports the news. He was accused at the time of using “undue influence” by a public administrator.
His license was suspended for a two-year period in 1995 for withdrawing $960,000 as a fee from a client's escrow account in 1983.
Anthony Marshall is the only child of Brooke Astor, from her first marriage. Her third and final marriage saw her enter one of the wealthiest American families. She and Vincent Astor, son of millionaire businessman John Jacob Astor, were married for five years before he died of a heart attack.
Astor became heir to a tremendous fortune and devoted herself to philanthropic activities. She inherited some $60 million, which reportedly multiplied into hundreds of millions, allowing her to donate some $195 million to libraries, museums and charitable groups.
Among beneficiaries were the New York Public Library, Metropolitan Museum of Art, the Museum of Natural History, Carnegie Hall and Central Park.
If convicted, Marshall could spend the rest of his life behind bars.
