Britney Fails Drug Tests Because She’s A ‘Pop Star’

The main issue discussed during today’s emergency hearing in the Spears-Federline custody case was the troubled singer’s 8 out of 14 failed drug tests.

The alarming number of tests for which Britney couldn’t be reached within the hour determined K-Fed to drag his ex back in court, despite their agreement on a custody/visitation schedule two weeks a go.

According to Usmagazine.com, a lawyer for Britney Spears’ ex-husband, Kevin Federline alleged that the singer failed to follow drug-testing procedures, missing most of her tests, aiming to make a motion to restrict Britney’s driving rights.

"There have been 14 requests and only eight have been responded to," Kaplan told Court Commissioner Scott Gordon, who is handling their custody case. "We have been in court on this exact issue at least three times."

"Mr. Federline doesn't want to take these children out of their mother's life, but what are we to do?" Kaplan said.

In response to the accusations, Spears' attorney Anne Kiley called the tests "unconstitutional," and that results for the tests Britney did submit to, came negative. Kiley also added that "the idea that she needs to respond within the hour is meaningless."

"Is the issue that Britney Spears needs to get up at 8:30 a.m. and answer the phone?" she went on. "She's a pop star with a No. 1 album. She is not up that early."

Gordon fired back: "She needs to take responsibility. The issue is to see if she can follow a court order. Since we started this, there have been lost phones, changed numbers, voicemails being left on someone else's voice mail," Gordon said.

Explaining Britney’s frequent phone number changes, her lawyer said that her client’s number often fell into the wrong hands.

However, the judge seemed to be amenable to Kiley’s last argument and is considering a change in the way in which Britney will be tested in the future.  

"Maybe we should set up a fixed appointment for her to be tested," he add. "The point is we cannot continue to do these weekly ex-parte motions."

The current order established early last month demands that the 25-year-old mother-of-two must submit to twice-weekly random drug and alcohol tests and is required to give a urine sample within six hours of being called.

"Just because Ms. Spears is unable to return a call within one hour doesn't reflect what kind of mother she is," Kiley was quoted by People as telling reporters after the hearing. "It's a nonsensical procedure. She could be in a movie or traveling. What matters is that she provides a sample within six hours and that she tests negative."

Gordon ruled that there needs to be a single number to which Britney can be reached by the testing facility and in case it gets changed, everyone involved must be notified.

Britney and K-Fed, who haven’t been in the same room more than several times since their separation in November 2006, were not present in court for the hearing.

Britney’s mother recently told Life & Style Weekly magazine that she blames herself for her daughter’s trouble, arguing that she wasn’t there for Britney when she needed her.

"I blame myself," 52-year-old Lynne told the magazine in an exclusive interview. "What mother wouldn't? I wish I'd been there more while she was touring. But I couldn't be. I had the other kids to look after."

According to Associated Press, Lynne’s book to be titled "Pop Culture Mom: A Real Story of Fame and Family in a Tabloid World," is set for release on the next Mother’s Day, May 11, 2008.
