Britney Chooses Trial Rather Than A Stained Rap Sheet

After she did the most unbelievable things in her the last couple of years, from shaving her head completely, attacking paparazzi, crying on the sidewalk and going in and out of rehab to actually losing the custody of her own children, as well as visitation rights for a little while, Britney Spears realized she has an image to protect.

The 26-year-old refused the plea offer of a year’s probation and a $150 fine in a driving-without-a-license case that goes back to her more hectic days, way before she lost weight and returned to her usual silhouette and made a grand comeback appearance at this year’s VMAs.

Britney’s lawyer, J. Michael Flanagan announced that the only offer his client would consider is one that reduces the charge to an infraction and requires her to pay only a $10 fine. "We don't want a misdemeanor," he told E! News. "This should be an infraction. No probation."

Of course, not money is the issue here, although the “Womanizer” singer is not in control of any of her assets at the moment, considering that on January 31, a court placed her under temporary co-conservatorship of her father James Spears and attorney Andrew Wallete, giving them complete control of her possessions.

Britney and her attorney just won’t accept that the singer’s reputation, as shaky as it already is, to be even more tainted by misdemeanor charges. Of course, a clean rep sheet is also a good thing for future incidents.

Flanagan has insisted on numerous occasions that Spears’ celebrity status, as well as her behavior in the last years, is the actual reason for the harsh charges. He said during a Los Angeles court hearing that his client doesn’t deserve even a minor criminal conviction on her record.

He also tried to prevent the case from going to trial, asking last month for the trial to be put on hold as Spears was "unable to participate meaningfully" in the proceedings, due to the fact that she still is in a conservatorship. Giving that none of his efforts to get a better plea offer or, at least, to postpone the hearings, Britney’s trial was set for Oct. 15 in Van Nuys. However, if the outcome is not the one expected, Flanagan says he will appeal any conviction.

The driving-without-a-license charge stems from an incident back in August 2007, when the pop sensation wasn’t at her best. She reportedly hit a parked car and left the scene without notifying the owner, a scene reportedly caught on camera by some paparazzi following her footsteps. The hit-and-run charge was eventually dismissed after the singer compensated the other driver for damages, but Britney was charged of driving without having a California license, although she did have a valid Louisiana license.
