The 15-year veteran detective that was shot and wounded gunman Stephon Allston outside of a nightclub in Queens has returned to full duty after the investigation found that he acted according to department guidelines. The detective had previously had his right to use a gun removed after it was found out that he had been drinking before the event took place.
The detective was off-duty and was enjoying himself at a Queens nightclub together with some friends of his. When leaving the club around 2 a.m. Sunday morning, he observed that a group of people were beating another man. The policemen identified himself and tried to stop the aggressors when one of them, Stephon Allston, aged 22, produced a firearm and shot at the officer, as witnesses say.
The policeman took out the gun he is allowed to carry while off-duty and fired 4 shots, two of them hitting the aggressor in the arm and leg. A few hours after the incident a test to determine the detective’s blood-alcohol level showed a value of 0.09, just a little above the legal limit for driving, which is 0.08.
The policemen faced penalties, because after the controversial situation when policemen shot Sean Bell, policemen are required to have a blood-alcohol level below the legal limit if they are to shot their guns.
However, the penalties have been lifted after future investigation has shown that the cop has acted as he was supposed to in such a situation. According to the Daily News, Police Commissioner Raymond Kelly said that “at grave personal risk, Detective Ivan Davison took appropriate and courageous police action to end an imminent threat of death or serious injury to himself and others.”
