Actor Kiefer Sutherland was officially charged on Friday with two misdemeanors counts of DUI in connection with his Tuesday arrest, the Los Angeles City Attorney’s Office announced.
The 40-year-old actor was pulled over by police early Tuesday after he allegedly made an illegal U-turn. Sutherland, already on probation for a previous drunken driving offense, was arrested after he failed the sobriety test. He was released after posting a $25,000 bail.
According to a City Attorney’s Office spokesperson, he was charged with driving under the influence and driving with a .08% or above alcohol level. The City Attorney's office also asked that Sutherland's probation be revoked.
"We have charged Mr. Sutherland with a second DUI offense within 10 years, which we believe also constitutes a violation of the terms of his probation from his 2004 conviction," said Nick Velasquez, a spokesman for the City Attorney's Office.
"Since he is still on probation from this 2004 DUI, we have also requested that the court revoke his probation and set a probation-violation hearing."
If convicted, the actor could serve a minimum of 96 hours behind bars on the DUI charge and up to a maximum of one year in jail and $1,000 fine while violating his probation could extend his punishment with a maximum of six more months.
Sutherland, who was ordered to complete an alcohol treatment program and community service after pleading no contest to drunken driving in 2004, is scheduled to be arraigned on the charges on October 16 in front of Judge Michael Sauer who sentenced Paris Hilton to jail earlier this year for violating the terms of her probation in a previous drunken driving case.
Besides his 2004 conviction, the "24" actor was convicted twice of alcohol related reckless driving in 1989 and 1993.
