Ed McMahon sued a
McMahon, 85, Johnny Carson’s sidekick on “The Tonight Show,” said the doctors failed to diagnose his broken neck and released him without taking an X-Ray, Reuters informs.
The lawsuit claims negligence, battery, elder abuse and intentional infliction of emotional distress. It was filed against Cedars-Sinai Medical Center, which the TV personality also accused of botching two subsequent spine operations that caused him months of discomfort and pain.
McMahon also sued the investment tycoon in the home of whom he says he fell in March 2007. He accused Robert Day of negligence over the condition of a ramp-like staircase at the house where the dinner party took place.
As the hospital has not yet received the lawsuit, Simi Singer, a spokeswoman for Cedars-Sinai declined to comment on the matter.
In a recent appearance on “Larry King Live” McMahon
explained that the injuries prevented him to work as a pitchman, and this led
to financial loss. He said he fell $644,000 behind on mortgage payments on his
“If you spend more money than you make, you know what happens,” McMahon said at the time, as quoted by the Associated Press. “You know, a couple of divorces thrown in, a few things like that. And, you know, things happen.”
The lawsuit says that McMahon has had to go through three surgeries in order to have his neck repaired. The most recent of the operations was performed on July 11.
McMahon tried to avoid the lawsuit and solve the problems with the hospital in an amiable way, but the discussions were not fruitful, his spokesman Howard Bragman said.
“That being said, we believe our suit has great merit and we expect a favorable resolution,” Bragman added, according to the Associated Press.
