Bon Jovi guitarist Richie Sambora was formally charged with DUI stemming from his late March arrest, but managed to avoid one misdemeanor count of child endangerment after driving erratically with his 10-year-old daughter in the car.
If convicted, Sambora faces a maximum penalty of six months in jail. His arraignment is set for May 7, People.com reported.
According to police reports, Sambora was pulled over on March 25 by a Laguna Beach officer who said he spotted the rocker's Hummer not following the traffic lanes. When he approached the musician, the police officer said he smelled alcohol on him and gave Sambora a field sobriety test, which he failed, before putting him under arrest.
There were four passengers in Sambora’s vehicle: his girlfriend, his daughter Ava and her teenage cousin.
Most recently, Laguna Beach Police Department recommended to prosecutors that Sambora should be charged with child endangerment.
"We did ask for a misdemeanor child endangerment charge to be filed against him," Sgt. Jason Kravitz said. "We also recommended they charge him with misdemeanor DUI."
However, in order to actually file child endangerment charges, prosecutors are forced to look into the actual behavior of the suspect and in this case, Sambora exhibited no "dangerous conduct."
Sambora is still in therapy after he entered a treatment facility last year. He confessed that he was drinking too much and wanted to get his life together and that’s why he chose to enter the facility.
"I'm still in therapy and stuff like that, but it's good. I'm great. I feel fine," said the guitarist during a "Today show" appearance.
His drinking problem came after he broke up with actress Denise Richards after they had dated for about a year. During the same month his divorce from Locklear was finalized and his father died. There’s no doubt that Sambora had a rough April.
