Actress Vivica Fox was arrested late Tuesday night for driving intoxicated with alcohol in Los Angeles.

The 42-year old was spotted by the California Highway Patrol driving her Cadillac SUV 15 mph over the speed limit of 65mph on California's 101 highway. She also couldn't stay in the correct lane. Vivica Fox was pulled over and failed the sobriety test and the breathalizer test. The breathalizer showed an alcohol concentration level over the 0.08 percent legal limit.

CHP spokesman Leland Tang told TMZ, "It was definitely over the .08 legal limit."

Fox was arrested, booked at the L.A. Police Department's Van Nuys Jail and released on her own recognizance. She will also have to appear in court at a later date, yet to be set.

Fox' manager refused to comment.
